Rotherham Council are looking for a Solicitor to work in the Social Care Team.Duties will Duties/Areas of Responsibility1.
To undertake a personal caseload of matters commensurate with the grade of the post.(a) This will entail responsibility for conduct of a caseload of child care matters from inception through to conclusion, which will include taking the client’s instructions, advising the client throughout the case, briefing counsel where appropriate and reporting fully to the client on the outcome.
This will involve co-working the caseload with Paralegals.(b) Ensuring that all work is completed to the standards and within time frames set by relevant legislation, court orders, service level agreements, key performance indicators and the office manual.(c) To advise and assist other legal staff in relation to child care matters.(d) To have a thorough appreciation and understanding of legislation concerning child care law.2.
To attend meetings of the Council’s Boards and Panels.(a) This may entail representing the Assistant Director of Legal Services at Board and Panel meetings, working parties and other meetings and acting as legal adviser to the meeting.
This may also involve deputising for the Service and Team Managers at the Public Law Outline Proceedings Panel.(b) The lawyer will advise both Members and officers as necessary, including advising on the delegation of powers.3.
To represent the Council in Court, at Inquiries, Inquests and Tribunals.(a) This will entail preparation for and advocacy in all relevant courts in which the lawyer has rights of audience.
The lawyer is responsible for assessing and advising on evidential matters, and will seek to prevent matters coming to Court where litigation would not be in the Council’s best interests.
The lawyer will need to have regard to the specific nature of child care proceedings.
VERSION 5 – March 2016 Last Updated: April 2017 All Families(b) Where the lawyer deems it to be appropriate, and in consultation with his or her line manager and following the appropriate protocols, the lawyer is responsible for instructing counsel to represent the client in Court, agreeing fees, and for making arrangements for support to be provided to counsel in such cases.4.
To advise clients generally.(a) This will include the provision of advice generally to CYPS Members and Officers as and when required, in writing, by telephone and in meetings and will involve the lawyer in personal contact with Members and officers at the highest level within the Council.(b) The lawyer will advise both Members and officers of current developments in the law and relevant legislative changes and will assist Members and officers to take account of these when formulating Council policies and objectives.(c) The lawyer will liaise with and, where appropriate, negotiate with other organisations and their officers, professional bodies and members of the public, and their solicitors.(d) The lawyer will have considerable independence in his or her own professional work area, but will consult with his or her line manager when appropriate.5.
To allocate work or provide advice, support and guidance to other staff in the legal department as required.
This will particularly apply to an allocated Paralegal, including carrying out regular work/file reviews and performance development reviews.6.
To participate in the provision of training for Members and officers on relevant legal matters.7.
To comply at all times with the requirements of the Solicitors Regulatory Authority / Bar Council / Charted Institute of Legal Executives Code of Professional Conduct for Solicitors / Barristers/ Legal Executives and the Lexcel Practice Management Standard.This position is working 37 hours per week, between the hours of 9-5pm.The post holder may occasionally be required to work out of hours.A criminal records check at the Basic level (unspent convictions only) is required.Start date 19th October
